​ TPS Promotions & Incentives (“TPS”) is an official provider of Bobcat branded merchandise.

Prior to using, and as a condition of access to this site, you have expressly accepted the Terms and Conditions of Use (“Terms”) of this site. By continuing to browse, shopping and/or purchasing on this site from time to time you are deemed to have accepted these “Terms” for each use.

Responsibility for Use of Credentials

This site is exclusively for the use of Bobcat Dealers in Canada and can only be accessed with their unique credentials. You are responsible for the use of the site associated with your credentials. Do not share your login or other personal information with anyone. Also, ensure that you log out of the site prior to leaving any computer you use to access the site.

Privacy Policy

Acceptance of the Terms of this site includes acknowledgement and acceptance of the Privacy Policy with respect to the collection and use of Personal Information and the Use of Cookies.

Pricing

Pricing for products and services offered on this site may change at any time without notice.

Pricing and products are offered on a “subject to availability basis”. Under no circumstances shall TPS be required to honour previously offered pricing. Pricing is also listed on an “Errors and Omissions Excepted” basis, such that any material inadvertent errors may be corrected by TPS at any time, including with respect to any order placed within the past 3 business days.

Communications

Consistent with Canadian Anti Spam Legislation (CASL) requirements, TPS will not send you any electronic message unless: (i) you have some form of business relationship with TPS, including making a purchase or enquiry on Bobcat Canada site; or, (ii) you have expressly asked or agreed to receive such commercial electronic messages such as those pertaining to new products, surveys and promotional offers, your personal information may be used to effect such communications. All electronic messages will clearly identify the sender, the purpose of the communication, and provide a mechanism by which you may unsubscribe from such messages. Additionally, should you wish to stop receiving such communications, please advise us via email at bobcatcanadacustomercare@tpscan.com.

Any violation of the above will be dealt with to the full extent of applicable laws. Notwithstanding any of these Terms, TPS and Bobcat reserve the right, without notice and in either or their sole discretion, to terminate your license to use this site and to block or prevent your future access to, and use of, this site.

If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

By using this site, you agree that the use of this site and all products and services provided in relation thereto shall be governed by the laws of the jurisdiction of the Province of Ontario.
